1. The service
Relay is a small, proprietary social app operated by Tobias Schmidt Services LLC (TSS), a California company. It is built for a limited group, kept to roughly 50 people. We can change, limit, suspend, or shut down any part of it at any time, at our discretion, and we can deny, cap, or suspend access or sign-ups for any reason. Features labeled beta or experimental can change or disappear without notice.
2. Who can use it
You must be at least 13, and sign-up checks your birthday. If you are between 13 and 18 (or the age of majority where you live), you may only use Relay with a parent or guardian who consents to these terms on your behalf. You are responsible for your account, for keeping your login safe, and for everything done through your account. One account per person, and you may not create an account for anyone else, use another person's account, or make a new account to dodge a suspension or ban.
3. Your content
This part matters, so it is worth reading carefully. Under the in app agreement, any content you create or post on Relay, specifically including photos, becomes the property of TSS upon creation. To the extent that ownership is not fully enforceable, you grant TSS a perpetual, worldwide, royalty free, sublicensable, and transferable license to host, store, use, reproduce, modify, distribute, and display that content (including your name, image, or likeness in it) for any purpose, including operating the service, without further notice, payment, or attribution. This grant survives deletion of your content or account to the extent copies exist in backups or moderation records, and it covers content processed by our service providers on our behalf.
You promise you have the rights to post what you post, that you have permission from people recognizable in it, and that it does not infringe anyone else's rights.
Originals and recent library photos. You agree that when you post a snap, TSS also stores the unedited full resolution original of that same photo, and on iPhones with an ultra wide lens the wider frame captured by the same shutter press. You further agree that if you grant Relay full access to your photo library, TSS stores copies of your thirty most recent photos. Location coordinates are stripped from all of these on your device before upload. These copies are your content under this section and are handled, retained and deleted on the same terms as everything else here. Access to them inside TSS is restricted and logged, and they are made available to anyone outside TSS only in response to a valid legal request. Declining or revoking photo library access in iOS Settings stops the library copies. The Privacy Policy describes this in plain language.
You decide what your camera and your library contain, and you are responsible for it. By granting Relay access to your camera or your photo library, you represent and warrant, for every photo Relay collects under this section, that: you own it or are otherwise entitled to provide it; you have obtained any consent, release or permission required from every identifiable person appearing in it, and from a parent or guardian where that person is a minor; providing it to TSS breaks no law, contract, or right of privacy, publicity or confidentiality held by anyone; and it contains nothing unlawful. You alone choose what to photograph and what remains in your camera roll, and you accept full responsibility for the content Relay collects as a result of that choice. TSS does not select, curate, review or verify what is in your camera roll and has no obligation to do so.
Your waiver, and your indemnity, for collected photos. To the fullest extent permitted by law you waive, release and agree not to assert against TSS or its owners, officers, employees, contractors and service providers any claim, demand or cause of action arising out of the collection, transmission, storage, retention or internal access of photos described in this section, including any claim founded on privacy, publicity, defamation, emotional distress, negligence, or the presence of any person or property in a photo you provided. You further agree to indemnify, defend and hold TSS and those people harmless from and against any claim, liability, loss, damage or cost, including reasonable legal fees, brought by you or by any third party, including any person appearing in a photo, arising from or relating to photos Relay collected from your device. This paragraph survives termination of these terms and deletion of your account, and it operates in addition to and without limiting section 11 or section 12.
4. Be decent
Relay is for sharing real moments with people you know. You agree not to:
- Harass, threaten, bully, stalk, defame, or intimidate anyone.
- Post anything illegal, hateful, defamatory, obscene, or sexual, including nudity or sexually suggestive material.
- Post content that promotes violence, self harm, suicide, or terrorism.
- Post other people's private information without their consent.
- Spam, scrape, harvest data, or use bots or automation on the service.
- Reverse engineer the app, probe or break its security, abuse rate limits, or interfere with how it works or with anyone else's use of it.
- Impersonate anyone or misrepresent who you are affiliated with.
- Use Relay for commercial promotion or advertising without our written permission.
Moderation. Photos and comments are screened on device, and content that is posted, reported, or flagged may be analyzed by automated AI models, including from partners such as Anthropic, PBC, to detect and remove prohibited material like sexual content, violence, and hate speech. Using Relay means you consent to this. Breaking these rules can get your content removed and your account suspended or deleted.
Zero tolerance. Relay has zero tolerance for objectionable content and abusive users. You can flag and report objectionable content, and block any user, from inside the app. When something is reported, we review it and, if it breaks these rules, remove the content and remove the responsible user within 24 hours. By using Relay you agree to these terms and to this zero-tolerance policy.
5. AI features
Fictional characters. Relay includes clearly labeled fictional characters powered by third party AI. They are not real people, nothing they say is a statement of fact, advice, or endorsement, and you agree not to rely on them for medical, legal, financial, or safety decisions. Character conversations are processed by a third party AI provider as described in the Privacy Policy. We may change, limit, or remove characters at any time.
Relay Glow. Glow is an optional, experimental AI retouch feature. When you use it, your original photo is sent to a third party AI provider to create a retouched version that is returned to you. It is best efforts, may produce artifacts, and is not a faithful representation of reality. You are responsible for anything you Glow and then post.
6. Invite codes and perks
Invite codes, streaks, badges, credits, and any similar items are features of the service, not property or currency. They have no monetary value, cannot be sold or exchanged, and can be modified, reset, or removed at any time.
7. Copyright complaints
If you believe content on Relay infringes your copyright, email help@relayyyy.com with the content, where you found it, proof of your ownership, and your contact info. We remove infringing content and terminate repeat infringers.
8. Feedback
If you send us ideas or suggestions, we can use them without restriction or payment. Please do not send us anything you consider confidential.
9. Apple
Relay is distributed through the Apple App Store, and Apple's standard Licensed Application End User License Agreement also applies. Apple is not a party to these terms, has no responsibility for the app or its content, has no obligation to provide support or handle claims about the app, and is a third party beneficiary of these terms with the right to enforce them against you. You confirm you are not in a country under a U.S. government embargo and are not on any U.S. government restricted parties list.
10. As is, no warranties
Relay is provided as is, as available, and with all faults. To the fullest extent the law allows, TSS disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non infringement. We do not promise the service will be uninterrupted, secure, error free, or fit your needs, or that content, including AI generated content, will be accurate or preserved. Experimental and personalization features are best efforts only. Back up anything you cannot afford to lose.
11. Limitation of liability
To the maximum extent permitted by law, you agree not to bring any lawsuit or claim against TSS or its people arising from the service or these terms, and you release them from all such claims, known or unknown. This includes a waiver of California Civil Code section 1542. In no event is TSS liable for lost profits or data or for indirect, incidental, special, or punitive damages, and in no event does TSS's total liability for all claims exceed fifty U.S. dollars or the amount you paid us in the past year, whichever is greater. Some jurisdictions do not allow certain limits, so parts of this section may not apply to you.
12. You cover us
You agree to indemnify, defend and hold TSS and its owners, officers, employees, contractors and service providers harmless from claims, liabilities, losses, damages and costs (including reasonable legal fees) arising from your content, any photo Relay collected from your device, your use of the service, your breach of these terms, or your violation of anyone else's rights. This includes claims brought by a person who appears in something you provided. You will not settle any such claim in a way that imposes an obligation on TSS without our written consent. This section survives termination of these terms and deletion of your account.
13. The fine print
- Talk to us first. Before filing any claim, email help@relayyyy.com and give us 30 days to work it out informally. Either side may still bring a qualifying claim in small claims court.
- Governing law. California law applies, and the exclusive venue for any dispute is the state and federal courts in Orange County, California. Any claim must be brought within one year of when it arose, individually and not as part of a class or representative action, to the extent the law allows.
- Changes. We may modify these terms at any time and will post the revised version with an updated date. Continued use means you accept the changes.
- Termination. We can suspend or end your access at any time, without notice, including if you breach these terms. You can stop using Relay and delete your account whenever you like. Sections 3 and 8 through 13 survive termination.
- No waiver. If we do not enforce a provision right away, we are not giving it up.
- Other. These terms plus the Privacy Policy and the in app agreement are the entire agreement between you and TSS. If a provision is unenforceable, it is narrowed to the minimum extent needed and the rest still applies. You may not transfer your rights without our consent; we may transfer ours freely.
